Terms and Conditions of Use

TERMS OF SERVICE

1. You agree that you are hiring Sayf-Trakk to be your delivery service and that you will be purchasing items directly from the stores of your choice.

2. You understand that you must send Sayf-Trakk your order confirmations or order numbers for us to know what you need picked up and delivered any particular week.

3. You understand that if anything is missing from your order or is different from what you ordered, that is something you that needs to be resolved between you and the store from which you purchased the items

4. You understand that you will pay Sayf-Trakk to deliver your items but that you will pay the store(s) directly for the actual items purchased.

5. If something is damaged in transit, Sayf-Trakk will do their best to replace the items. However, the liability limit to Sayf-Trakk will not exceed the cost of the items damaged and the cost to deliver them.

6. Any item that is damaged before Sayf-Trakk picks it up will be the responsibility of the store/vendor from which it was purchased. Sayf-Trakk is not responsible for checking items when they are picked up. The point of “no contact” means they will not be handling or taking apart the packaging the store provides.

7. You understand that Sayf-Trakk is not responsible for the availability of items you wish to purchase from any store or for any changes to the pricing of items you are purchasing

8. If Sayf-Trakk offers special add-on items/packages (ie picnic supplies) which contain items from multiple stores, then Sayf-Trakk will notify you if they have more demand than they can fill for any particular offer.

9. You understand that deliveries are “No Contact” and we ask that you please do not approach our delivery drivers when they are making your deliveries. You can thank them from a distance or wave through the window—that will make them happy too.

10. You understand that you will be notified of your delivery day (currently Niagara-on-the-Lake is Friday) and you will be notified when your package(s) have been delivered to your location. You or the person receiving the delivery will be responsible for retrieving these items, once they have been delivered, in a timely manner.

You agree you will not hold Sayf-Trakk responsible for any damage to items you did not retrieve once they were delivered.

1. If you cancel a delivery before 5:00 p.m. the day before it was to be delivered, we will refund your delivery fee. Any cancellations after 5:00 p.m the day before delivery are non refundable.

2. You agree that Sayf-Trakk cannot be held liable for delivery to the wrong location, if Sayf-Trakk has been provided with the incorrect delivery address.

3. Sayf-Trakk will not knowingly deliver any pornographic items, drugs or forbidden products. If Sayf-Trakk becomes aware any of these items are in a delivery order, Sayf-Trakk will not deliver the order.

4. Sayf-Trakk will not be liable for any product warranties or any legal actions against vendors, couriers, or service providers.

5. Sayf-Trakk reserves the right to alter or add to these terms of service at any point. Changes will be posted on this website.

GOVERNING LAW:

These terms of service will be governed by the laws of the Federal Government of Canada and the laws and bylaws of the Government of Ontario.

All parties hereby agree to resolve any disputes or disagreements that cannot be resolved amicably between Sayf-Trakk and the disgruntled party, shall be resolved through arbitration in the Province of Ontario.
